The USPTO announced on Monday that once a trademark application has been published by the examiner, any subsequent requests to correct and/or amend the application will be processed as amendments/corrections after publication. The practice of utilizing the TM Photocomp mailbox for amendments and/or corrections to trademark applications after publication is discontinued. The USPTO has stated that "[a]ll post-publications amendments/corrections should be submitted no later than 6 weeks after the publication date to insure that the amendment/correction can be considered prior to the issuance of the notice of allowance or registration certificate." The utilization of this new process (of treating these changes as amendments/corrections after publication) is intended to "ensure that the requested amendment is matched with the proper application, uploaded into the database, and reviewed in a timely manner." Minor typographical errors may still be corrected by e-mailing the USPTO at its designated e-mail address.
